Ezra Clark to James Downey
This indenture made the sixth day of August
in the year of our Lord eighteen hundred and four between Ezra Clark for and in
consideration of the sum of three hundred dollars to him in hand well and truly
paid by the said James Downey before the ensealing and delivery of these
presents the receipt and payment of which the said Ezra Clark doth hereby
acknowledge and thereof and therefrom doth acquit release exonerate and forever
discharge the said James Downey his heirs Executors and administrators by these
presents, and doth hereby grant bargain sell alien enfeoff convey and confirm
unto the said James Downey his heirs and assigns forever. All that part of
section number thirty two in fourth township and second fractional range of
townships in the Miami Purchase as follows viz: Beginning at the South east
corner of said section and running west forty nine poles and six tenths of a
pole thence North one hundred and eight poles and eight tenths of a pole.
Thence East forty nine poles and six tenths of a pole thence South one hundred
and eight poles and eight tenths of a pole to the place of beginning containing
thirty three acres one hundred and sixteen poles and one half pole. To have and
to hold the said premises with all and singular the appurtenances thereunto
belonging or in any wise appertaining to the only proper use benefit and behoof
of the said James Downey his heirs and assigns forever and the said Ezra Clark
for h imself heirs executors and administrators covenants and grants unto and
with the said James Downey his heirs executors and assigns that he the said
Ezra Clark is lawfully and rightfully seized of the before mentioned premises
and of every part and parcel thereof and also that he has good right full power
and lawful authority in his own right to grant, bargain, sell, and convey the
same in manner and from aforesaid and the said Ezra Clark for himself and his
heirs, executors, and administrators further covenant and grant unto and with
the said James Downey his heirs Executors administrators and assigns that the
before mentioned premises with all and singular the appurtenances thereunto
belonging or in any wise appertaining unto the said James Downey his heirs and
assigns against the said Ezra Clark his heirs, executors, and administrators
and every other person or persons whatsoever shall and will warrant and by
these presents forever defend. In witness--the said Ezra Clark together with
Phoebe his wife have hereunto set their hands and affixed their seals the day
and date above mentioned.

Hamilton County ss: Be it remembered that on
the 8th day of August in the year of our Lord One thousand eight
hundred and four personally appeared before me James Mason one of the Justices
of the Peace in the county aforesaid, Ezra Clark and Phebe his wife, who being
examined separately and apart from her said husband declares that she is under
no coercion or constraint from her said husband. They do severally acknowledge
the within Instrument to be their act and deed for the purposes therein
mentioned. Given under my hand at Columbus the date above written.
