CLARK & DANIEL MULFORD of Hamilton County to MATTHIAS DENMAN of New Jersey
This Indenture made the Nineteenth day of
November in the year of our Lord one thousand eight hundred and one Between
Ezara Clark and Daniel Mulford of Hamilton County and Territory North West of
the Ohio River of the one part and Matthias Denman of Essex County and State of
New Jersey of the other part.
Witnesseth that the said Ezara Clark and
Daniel Mulford in and by a certain obligation unto their hands and seals
bearing even date __the presents stand bound unto the said Mathias Denman in
the sum of Six hundred & eight dollars and sixty two cents as will appear
by the said recited obligation refference being there unto had will more fully
appear. Now this Indenture Witnesseth that the said Ezara Clark and Daniel
Mulford for and in consideration of the aforesaid Debt or Sum of Six hundred
& eight dollars and sixty two cents, And for the better security and
payment thereof unto the said

Matthias Denman his heirs Executors Administrators
and Assigns, in discharge the Said recited obligation and for and in
consideration, the further Sum of one dollar unto the said Ezara Clark and
Daniel Mulford in hand paid by the said Matthias Denman at and before the
sealing and delivery of these presents the receipt whereof is hereby
acknowledged Hath granted back_____and confirmed by these present doth
grant___sell, release and confirm unto the said Matthias Denman his heirs and
assigns all that tract or parcel of land to wit: Three hundred and fifty three
acres & one third acre be it more or less lying and being in Thirty Second
Section Fourth Township and Second Fractional Range of townships in the Miami
Purchase beginning at South East Corner and running West eighty chains, thence North
twenty chains adjoining Saml Muchmore, thence North sixty chains thence East
seventeen chains and thence East 30 chains & fifty links thence South
thirty two chains and fifty seven links thence East thirty two chains and fifty
7 links thence South forty seven chains and forty three links to the beginning
together with all and singular the rights priviliges and appurtenances
thereunto belonging or in any wise appertaining with the reservations,
remainders, rents, issues and profits and also the estate right, title,
interest, profits claims and demands whatsoever of the said Clark & Mulford
of in and to the same. To Have and to hold the said described tract of Land
hereditarements and premises hereby granted mentioned or intended so to be with
the appurtenances unto the said Matthias Denman his heirs and assigns to the
only proper use benefit and behoof of him the said Matthias Denman his heirs
and assigns forever. Provided always nevertheless that if the said Clark and
Mulford their heirs or assigns administrators or any of them shall and do well
and truly pay or cause to be paid unto the said Matthias Denman his heirs or
assigns the said debt or sum of six hundred and eight dollars and sixty two
cents on the day and time mentioned and appointed in the Said Obligation for
payment of the same without any fraud or further delay and without any
deduction or abatement to be made of any thing for and in respect of any taxes
charges or assessments whatever that then and from thence fourth as well this
present Indenture and the Estate right hereby granted the Said Obligation shall

and become absolutely void of all intents and
purposes anything herein contained in anywise notwithstanding.

hereunto interchangeably set their hands and seals the day and year first above

Esq. One of the justices assigned to keep the peace in and for the said County,
Ezara Clark and Daniel Mulford who acknowledged the within instrument of
writing to be their voluntary act and deed. In testimony whereof I have
hereunto set my hand and affixed my seal this Nineteenth day of November 1801.

NB: It is to be understood and I hereby
declare…
One hundred and ten acres of the within
mentioned mortgaged lands which Benjamin Mulford is to have is not to be
included in the within Mortgage which I hereby release and exonerate from the
same.

Received this 25th day of June
1806 of W. Ezra Ferris by the hand of W. Samuel Mushmore the sum of
Two hundred and twenty one dollars in part
pay of a bond and mortgage given by Ezra Clark and Daniel Mulford to Matthias
Denman and assigned by Denman to me which sum is to be (?accredited?) towards
extinguishing the lien of the said mortgage on that part of the land which the
said Ferris purchased and is so inserted in the bond and mortgage. (? So
