Will written Feb 22, 1886 Codicil written March 7, 1886, WillprovedMarch22,1886 City of Lockport, County of Niagara, New York Last Will and Testament of Mary Hunting, Deceased Be it Remembered, that heretofore, to-wit: On the 12th day ofMarchinthe year of our Lord one thousand eight hundred and eighty-six,MosesSHunting and John E Pound the executors named in the lastWillandTestament of Mary Hunting late of the City of Lockport in theCountyofNiagara deceased...............on the 22nd day of MarchA.D.1886satisfactory evidence was produced and presented tosaidSurrogate....andonthat day said petitioner appeared and it appearingthat-- Richard CHunting, Edith Hunting and Josephine Hunting areminorsEdward J Tayloron his consenting thereto was appointed the Special Guardian for said minors to appear for themandtakecare of their interests in this matter......... WILL I, Mary Hunting of the City of Lockport Niagara County New YorkwidowofBen J Hunting deceased do make publish and declare this my lastwillandtestament in manner following viz First I hereby authorize and direct my executors hereinafternamedtouse and expend any money that may come into their hands belongingtome inclearing the house and lot Number 251 East Genesee Street intheCity ofLockport from the Judement or decree or forclosure of mortgageinfavor ofMary C Wortes? which is now owned by Stanley E Filseius?ofMedina andalso from all taxes assessed against said house and lotandwhich are alieu thereon it being my desire and intent to save saidhouseand lot forthe benefit of my children. Second, I hereby authorize and direct my said executors to causetobeerected on the lots owned by me in Montrose, Cook County,Illinoistwodwelling houses at an expense not exceeding two thousanddollars tobepaid for as in the first Item herein. Third: I earnestly desire that my three children should bebroughtup& educated under Cahtolic influence & educated asfar aspracticableinCatholic schools. I desire that my son Richard C shouldreceive agoodCatholic Education fitting him as far as practicable forsuch callinginlife as he may show himself fitted for & as the means atthe commandofmy said Executor will allow & I am especially anxious thatmydaughteredith shall be well and thourghy educated. Her fatherwastenderlyattached to her & it was his last expressed desire beforehisdeath sothat she might be fitted for Teaching or other desireablecallingorposition in life. I desire that Richard & Edith go to theConventherefor some years & then if practicable to a better & highergradeofCatholic school. I commit my little darling baby girl Josephinetothefatherly & motherly care of Fred & Kittie Hunting whom Igreatlyrespect& tenderly love enjoining especially on them to see thatthelittledarling is educated & brought up a Catholic as their motheriflivingwould herself desire to bring her up. Fourth: Whatever money may come into the hands of mysaidexecutorsbelinging to me not herein before appropriated I direct mysaidExecutorsto invest in good securities hoping that the principal ofwhatmoney Imay have may be saved for said children until they are twentyoneyearsof age or as hereinafter married. Fifth: I hereby give devise & bequeath to my three childrenallmyestate & property both real & personal to be divided betweenthemequallyshare and share alike unless sickness or other exigency intheopinion ofmy executors should clearly make it best & proper toexpendmore for thebenefit of some or (other?) of said children than fortherest. Shouldany of said children die before twenty one years ofagewithout lawfulissue then the share going to said deceased shall go tothesurvivors.Whatever sums may be going to said children under thiswillshall be paidto each on arriving at the age of twenty one years orsooneron marriage.Should either marry before twenty one years of age. Sixth: I hereby authorize & empower my said executors to leaseorsell& convey any or all my real estate & wherever located & givegood&sufficient deeds for the same with or without warranty& for suchprices&on such terms of payment as they may think proper & investtheproceedsingood real estate securities. Seventh: I hereby make constitute & appoint Moses S. HuntingandJohnE Pound executors of this my last will & testament relying onthemtoprotect care for & watch over my three orphan children herebyrevokingallformer wills by me made In witness whereof I have hereto setmy hand&seal this 22d day of Feb A.D. 1886 Mary married Benjamin Johnson Hunting, son of Moses Solomon Hunting and Josephine Jennett Goodwin. (Benjamin Johnson Hunting was born in 1848 in New York City, New York, New York and died in 1886.) |
